In order for an author's piece to be considered for publication, it should be submitted with a signed copy of the following agreement:

AUTHOR LICENSE AGREEMENT

 

It is mutually agreed that the article entitled _______________________ will be placed in the hands and become the property of the DuPage County Bar Association (DCBA) together with any necessary artwork and proof of ownership, or permissions or assignments of copyright quotations from text or illustrations published or copyrighted elsewhere.  The Author hereby issues an unlimited license to DCBA and acknowledges and agrees that DCBA may publish, republish, broadcast, disseminate and use the above article in whole or in part via any media (including without limitation, television, radio, the world wide web, email, electronic libraries, Westlaw, Lexis or through any other database providers or licensors) without restriction and without limit of time.

 

The author, ________________________________________, warrants that the article is original and that it contains no matter which is libelous, obscene or infringes any existing right of privacy, copyright, trademark or any other statutory or common law proprietary or civil right, and is not otherwise unlawful, and agrees to indemnify, defend and hold DCBA, its directors, officers, employees and agents harmless against any claims to the contrary.

 

The author grants to DCBA, for the full term of copyright available in each country worldwide under any copyright law now or hereafter in effect with respect to the article, any and all literary, copyright and publication rights author may have in the article, including all rights under the copyright laws of the respective countries, including without limitation, book edition, electronic versions, general publication, transcription, translation, sound version, video, or any other version or media now existing and/or later to be created.

 

DCBA agrees to publish the article at its own expense, and to market and distribute the published article in such style and format as it determines expedient including, but not limited to, reprints of the article, as well as film, facsimile, tape and electronic transmission.  DCBA has complete discretion as to placement of the article and reserves the right to edit the article according to DCBA’s standing format and style practices and in order to fit space constraints within the publication.  DCBA reserves the right to pull the article from publication at any time for any reason whatsoever.
